1. Acceptance of terms

These Terms of Use (“Terms”) are a legal agreement between you and IRONCORE GOVERNMENT SERVICES LLC (“SwearGPS,” “we,” “us,” or “our”) governing your use of the SwearGPS mobile application and the SwearGPS website (together, the “Service”). By downloading, installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who may use the Service

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service, and old enough to form a binding contract where you live. Unfiltered Mode contains adult language and is intended for adult users. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.

3. App usage and license

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Service on a device you own or control, for your own personal or internal business use. This license does not transfer any ownership rights to you. All rights not expressly granted are reserved.

4. Navigation limitations

The Service provides navigation assistance based on map, routing, and location data that may come from third-party sources. That data may be incomplete, inaccurate, outdated, or unavailable in your area. Roads change, closures happen, signage is updated, and conditions shift. The Service may also be affected by GPS signal quality, device performance, network availability, and operating system behavior.

The Service is not designed or certified for use in emergency response, aviation, marine navigation, commercial dispatch-critical operations, or any application where inaccurate routing could result in death, personal injury, or severe property or environmental damage.

5. No guarantee of routing accuracy

We do not warrant or guarantee that any route, direction, estimated arrival time, distance, road condition, speed limit, or alert provided by the Service is accurate, complete, current, or suitable for your vehicle or situation. Route suggestions may not account for vehicle height, weight, width, or load restrictions, hazardous-material routing, seasonal or temporary closures, or local access rules. Verify routing independently where accuracy matters.

6. Driver responsibility

You are solely responsible for the safe operation of your vehicle. By using the Service you agree that:

• You will obey all applicable traffic laws, signals, signage, and posted speed limits, and will drive according to actual road and weather conditions.
• You will not interact with the app while the vehicle is in motion. Set your route before you drive.
• You will use hands-free and voice interaction where available, and will comply with all distracted-driving laws that apply to you.
• You will not rely on the Service in place of your own observation and judgment.
• You will not follow a route instruction that would be unsafe, unlawful, or physically impossible for your vehicle.

SwearGPS does not encourage speeding, aggressive driving, or reckless behavior. Humorous commentary is entertainment and is never an instruction to drive unsafely.

7. Community reports

Where road and community alert features are available, some information may be submitted by other users. Community reports are unverified, may be inaccurate or outdated, and are provided on an as-is basis. They are not official notices from any government, law enforcement, or transportation authority, and we do not guarantee that any hazard, closure, incident, or enforcement activity will be reported at all. Do not rely on community reports for safety-critical decisions.

If you submit a report, you agree to submit only information you believe to be accurate, to not submit reports while driving, and to not submit false, harassing, or unlawful reports.

8. User-generated content

You are responsible for any content you submit through the Service, including community reports, feedback, saved place names, and support messages. You retain ownership of your content. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, display, and use that content for the purpose of operating, improving, and promoting the Service.

We may remove or refuse any content at our discretion, including content that is unlawful, misleading, abusive, infringing, or that violates these Terms.

9. Mature content and profanity

SwearGPS includes optional humor and optional profanity. Unfiltered Mode contains adult language and is disabled by default. It is enabled only by a deliberate user action and can be disabled at any time. Humor and commentary levels can also be reduced or turned off entirely. By enabling Unfiltered Mode, you acknowledge that you are choosing to receive adult language, and you are responsible for who else can hear it in your vehicle.

10. Premium subscriptions

SwearGPS Pro is an optional paid subscription that unlocks premium voice personalities, Unfiltered Mode, advanced navigation features, additional personality modes, and future Pro features as they are released. Current pricing is displayed before purchase. Subscriptions are purchased and billed through the app store or payment platform where you subscribe, and are subject to that platform’s terms in addition to these Terms. See our Subscription Terms.

11. Automatic renewal

SwearGPS Pro is billed on a recurring basis and renews automatically at the end of each billing period unless you cancel before the renewal date. Your account with the app store or payment platform will be charged at the then-current price for the applicable period. Pricing may change with notice where required by the platform or by applicable law.

12. Cancellation

You can cancel at any time through the app store or platform where you purchased the subscription. Cancellation takes effect at the end of the current paid period. After cancellation, Pro access continues through the end of the period you already paid for, and then reverts to the free version of the Service.

13. Refunds

Refunds for subscriptions purchased through an app store or payment platform are handled by that platform under its own refund policy, and are generally subject to that platform’s discretion. We do not control those decisions and do not offer a separate refund guarantee. If you believe you were charged in error, contact the platform where you subscribed first, and then contact us at support@sweargps.com if you still need help.

14. Third-party services

The Service may use or link to third-party services, including mapping and routing providers, app stores, payment processors, analytics providers, and hosting providers. We are not responsible for third-party services, their content, their availability, or their terms and privacy practices. Your use of a third-party service is governed by that party’s terms.

15. Intellectual property

The Service, including its software, design, interface, artwork, brand names, logos, voice personalities, characters, scripts, and written content, is owned by IRONCORE GOVERNMENT SERVICES LLC or its licensors and is protected by intellectual property laws. “SwearGPS” and the SwearGPS logo are marks of IRONCORE GOVERNMENT SERVICES LLC. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Service except as expressly permitted by law or by us in writing.

SwearGPS is not affiliated with Google Maps, Waze, Apple Maps, or other navigation providers unless explicitly stated. All third-party names and marks are the property of their respective owners.

16. Prohibited use

You agree not to:

• Use the Service in any way that violates applicable law or these Terms.
• Interact with the app in a manner that creates a distracted-driving hazard.
• Reverse engineer, decompile, or attempt to extract source code, voice assets, or scripts from the Service.
• Access the Service through automated means, scrape it, or attempt to circumvent rate limits, security controls, or subscription entitlements.
• Submit false, fraudulent, harassing, defamatory, infringing, or unlawful content or reports.
• Interfere with, disrupt, or overload the Service or its infrastructure.
• Resell, sublicense, or commercially redistribute access to the Service without our written permission.
• Use the Service in any safety-critical application described in Section 4.

17. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY ROUTE, DIRECTION, ESTIMATE, OR ALERT WILL BE ACCURATE OR AVAILABLE. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRONCORE GOVERNMENT SERVICES LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, TIME, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TWENTY-FIVE UNITED STATES DOLLARS ($25).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

19. Indemnification

You agree to indemnify and hold harmless IRONCORE GOVERNMENT SERVICES LLC and its officers, members, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or the rights of a third party.

20. Termination

You may stop using the Service at any time and may delete the app from your device. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

21. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page, and where the changes are material we will provide additional notice through the app or by other reasonable means. Your continued use of the Service after an update takes effect means you accept the revised Terms.

22. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the Commonwealth of Pennsylvania, and you consent to the personal jurisdiction of those courts. Nothing in this section deprives you of any mandatory consumer protections available to you under the law of your country of residence.

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy and Subscription Terms, are the entire agreement between you and us regarding the Service.
